Magica Net

  1. Service Activation
  1. The address of the Customer Premises where the Customer desires to have the Service(s) installed by Magica Net. (Magica Net) shall be the address given in the relevant column in the Customer Agreement Form duly completed and signed by Customer.
  2. Magica Net or its Associate after satisfying itself about the correctness of the information stated in the said application by the Customer, will intimate Customer to pay the required charges together will such taxes, duties and levies as may be determined by the authorities.
  3. Customer shall grant to the personal authorized by Magica Net'S discretion, access to Customer Premises as may be necessary for installation and maintenance of the circuit for connecting to the internet.
  4. For the removal of doubts if any it is hereby clarified that the Connection and Service(s) will be provided by Magica Net at the Customer Premises indicated by the Customer in the above said application form only on the Customer unconditionally accepting these terms and conditions. For this purpose the Customer unconditionally accepting these and conditions as a token of having accepted the same and deliver it to Magica Net.
  5. Pre-paid customer's account will automatically get disconnected on expiry of the validity period or the pack value whichever is earlier.
  6. The Connection is given by Magica Net only for providing Service(s) to the Customer alone. The Customer may not reassign the service to any other third party. Service(s) is not for resale.
  7. The tariff mentioned may vary and is subject to the last mile distance.
  1. Prohibitory Clauses
  1. The Customer shall not use any hardware and or software that are unlawful or not permitted by the appropriate authorities. The Customer shall make available on demand to Magica Net, full and complete access to the equipment connected to Magica Net's Service(s) for technical scrutiny and detailed inspection. The Customer shall not use any encryption equipment that is beyond the level permitted by the appropriate authority without the prior written permission from the appropriate authority. In all such events the Customer shall ensure to deposit one set of keys with the appropriate authority and submit one copy of the written approval/permission issued by the appropriate authority to Magica Net before installing any such equipment.
  2. The Customer shall ensure to use Service(s) as per the prevailing laws of the country. The Customer shall ensure that the network is not used for any illegal and or antinational activity. The Service shall not be used in any manner that may endanger or make vulnerable any network infrastructure. Violation of any of these terms and or any acts such as break-ins or attempted break-ins of Indian networks will be regarded as anti- national acts and shall attract penal action by the concerned authorities, including but not limited to disconnection by Magica Net and liable to pay damages to Magica Net.
  3. The Customer shall not send unsolicited messages and shall not send messages (spamming) to Magica Net or anyone else in a language that is prohibitive, defamatory, vulgar, vituperative, or otherwise via Services. Should the Customer violate this condition, Magica Net reserves the right to disconnect Service(s) and the Connection permanently without prejudice to any other action under the laws of the country.
  4. The Customer is required to ensure that objectionable or obscene or pornographic messages or communications, which are inconsistent with the established laws of the India, are not made/published by him or by any other person using his facility. Should the Customer violate this condition, Magica Net reserves the right to disconnect Service(s) and the Connection permanently without prejudice to any other action under the laws of India and shall also be liable for damages to Magica Net.
  5. User ID and password is liable to be kept confidential by customer and the same shall not be shared or disclosed for to any other person. If the customer is negligent in keeping User ID and password confidentially, Magica Net is not liable for any loss/damage arising out of the same.
  6. The Customer shall not resort to hacking or destroying the Internet sites including the websites of Magica Net. The Customer is required to desist from putting unsolicited messages on server hosted at Magica Net's premises. Should the Customer violate this condition, Magica Net reserves the right to disconnect Service(s) and the Connection permanently without prejudice to any other action under the laws of the country. The Customer shall not object to any steps taken by Magica Net to prevent sending or receiving spam mails through the service. The Customer shall ensure that objectionable or obscene messages or communications inconsistent with the established laws of India are not made, created, downloaded, modified, transmitted or retransmitted by the Customer or allow any other person using the Customer's ID and password
  7. The Customer is prohibited from misusing or copying the software supplied by Magica Net as the Copyright of the said software is protected and misusing or copying of the same is likely to attract legal action under Copyright Act 1957.
  8. The Customer is prohibited from transferring the rights and facilities to any other person. The Customer is not permitted to commercially exploit Service(s) without the prior written permission of Magica Net and upon compliance of such terms and conditions as may be determined by Magica Net. The Customer is given only a limited use of Services.
  9. The Customer is required to fully comply the provisions of the Indian Telegraph Act, 1885, and the Indian Telegraph Rules made there under and any amendments or replacements made thereto from time to time.
  10. The Customer is required to ensure that IP Telephony is used as permitted by the Government of India, Ministry of Communication and Information Technology, which is mentioned in the definition section of this terms and conditions.
  11. The Customer who is desirous of obtaining interconnection with Magica Net who wants to use this interconnection for the provisioning of Internet services to its customers shall ensure to have a valid ISP license from the appropriate authority and will also need to have the express written permission of Magica Net.
  12. Magica Net reserves the right to disconnect Service(s) and the Connection permanently, without notice, without prejudice to any other action under the laws of the country, should the Customer violate any of the conditions contained herein.
  13. Magica Net reserves the right to disconnect Service(s) & Connection permanently if the Customer defaults on the payment to the Associates in case of Services.
  14. Magica Net reserves the right to control/monitor the functionality of the Device provided to the Customer, from its end, during the Service period.
  1. The Customer is required to use the necessary equipment that includes Telecom Engineering Centre (TEC), New Delhi approved Interface Equipment for accessing the Service(s) . In case where it is necessary to pay charges to the appropriate authority for connecting the equipment, the Customer shall complete the necessary formalities with local offices of the aforesaid authorities.
  2. The Customer assumes total responsibility and risk for use of the Service(s) which is provided on an "AS IS and AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of title, non-infringement or implied warranties of merchantability of fitness for a particular purpose. Neither Magica Net nor its Associate make any such or such other express or implied warranties, with regard to any merchandise, information or service provided through the Internet and they shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely the Neither Magica Net nor the Associate warrants that the service will be uninterrupted or error free or that any information, software or other material accessible on the service is free of viruses, worms, Trojan horses or other harmful components.
  3. The Customer understands further that the Internet contains unedited materials, some of which are sexually explicit or may be offensive to some people. Customer's access to such materials will be at his own risk. Magica Net or the Associate has no control over the same and accepts no responsibility whatsoever for such materials.
  4. Under no circumstances shall Magica Net, its Associates or its contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from Customer's use of or inability to use the service or access the Internet or any part thereof, or Customers' reliance on or use of information, service or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission or any failure of performance.
  5. It would be responsibility of the Customer to ensure that the password, where provided, is kept secret and not disclosed to anyone and to change the password immediately after installation. The Customer shall not part with the password with anyone and Magica Net shall not be held liable for the misuse of the Customer's facility under any circumstances.
  6. Magica Net reserves the right to engage Associate to render Customer care service for handling the complaints of Customer. Upon such engagement Magica Net will intimate the Customer about the same and thereafter the Customer shall deal with the said Associate. If at any time, during the continuance of Services, the performance in whole or part, of any obligation under it shall be prevented or delayed by reason of war, hostility, acts of the public enemy, civil commotion, sabotage, fire, flood, explosion, epidemic, quarantine restriction, strikes, lock-out or act of GOD etc., the Customer shall not have any claim for damages against Magica Net in respect of such non-performance or delay in performance of Service(s).
  1. Disputes
  1. If any dispute arising out of these terms and conditions between Magica Net and Subscriber require intervention and/or adjudication by Courts then the Courts located within the limits of City of Bangalore will alone have jurisdiction and jurisdiction of other Courts are hereby excluded.
  1. Disclaimer
  1. While every effort is made by Magica Net to provide highest quality of services to the Customer, the Customer acknowledges that the linking, quality and speed of data transmission of the Customer with the network is entirely dependent on various external factors and agencies/appropriate authority over which Magica Net has no control. Accordingly, Magica Net shall in no event be responsible to the Customer with Magica Net's network computer or the deficiency in data transmission between the Customer and Magica Net network computers, or for any inconvenience, damage or loss that may be caused to any one or of any kind arising there from.
  2. Magica Net does not claim any ownership of any material that Customer shall publish, transmit or distribute using the Service. By using the Service to publish, transmit or distribute material or content, Customer shall warrant that the material or content complies with the provisions of this Agreement, (ii) consent to and authorize Magica Net, its agents and affiliates to reproduce, publish, distribute, and display the content worldwide and (iii) warrant that Customer have the right to provide this authorization. Customer shall acknowledge that material posted or transmitted using the Service may be copied, republished or distributed by third parties, and agree to indemnify, defend and hold harmless Magica Net, its agents and affiliates for any harm resulting from these actions. Any sensitive or confidential information posted, stored, transmitted or disseminated by Customer is done so at his/her sole risk, and neither Magica Net nor its Associates shall have any liability whatsoever for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to such actions. Customer shall acknowledge that software programs claiming to be capable of encryption are commercially available. Magica Net makes no representation or warranty regarding the effectiveness of these programs.
  1. Liability
  1. Notwithstanding anything mentioned in this terms and conditions if Magica Net is not able to provide the service as determined for any reason whatsoever, the liability of Magica Net shall be limited to the amount paid by the customer to Magica Net or Associate for installation of the said services.
  1. Authorization
  1. Customer shall comply with the terms and conditions of all end user license agreements accompanying any software or plug-ins to such software distributed or used in connection with the Service including, without limitation, the Magica Net Software License Agreement, as these agreements may be amended from time to time. All end user licenses will terminate upon the termination of this Agreement, and, at such time, Customer/ Subscriber shall destroy all versions and copies of all software received by him/her in connection with the Service.
  1. Material Downloaded from the Service
  1. In addition to any content that may be provided by Magica Net, Customer may access material through the Service that is not owned by Magica Net. Any such material may be downloaded from the Service only for personal, non-commercial use, and not allowed to redistribute that material over any network (other than a residential home network located in the Premises) or sell or offer for sale that material. Unless other terms and conditions expressly apply to specific content, Customer may make: (a) one machine readable copy, (b) one backup copy, and (c) one print copy of any material downloaded from the Service; any other copying, or any redistribution or publication of any downloaded material, including, without limitation, posting to any other online service, must be with the express permission of the relevant copyright holder. In any permitted copying, redistribution or publication of copyrighted material, any changes to or deletion of any copyright notice are prohibited. Other terms and conditions may apply to use of any content or material made available through the Service that is not owned by Magica Net. Customer shall read those terms and conditions to learn how they apply to them and the use of any content other than that of Magica Net.
  1. Magica Net Fair Usage Policy (Magica Net FUP)
  1. The evolving internet broadband scenario in India necessitates the management of limited high-speed bandwidth and network resources in the larger interests of Customers. In line with the practice followed by major international Internet Services Providers and in its continuous endeavor to provide best possible Broadband Internet experience to all its customers, Magica Net adopts a Fair Usage Policy (Magica Net FUP) with an intent to ensure that the excessive bandwidth usage by a small segment of customers does not impact service quality for a large set of customers.
  2. Magica Net FUP is applicable to all existing and future unlimited plans offered by Magica Net unless specifically withdrawn at the discretion of Magica Net. Taking into consideration the maximum reasonable usage required by the average user Magica Net has established a monthly data transfer threshold (Fair Usage Limit) for the various unlimited tariff plans.
  3. Data transfer in excess of Fair Usage Limit as per the applicable tariff plan shall be tread as a violation of Magica Net FUP.
  4. Upon such violation of FUP, Magica Net shall contact the Customer suggesting for reduction in usage or upgrade to a higher bandwidth plan.
  5. Despite the above, if the customer fails to upgrade to a high speed plan or continue to violate the Magica Net FUP, Magica Net reserves the right to suspend or terminate the customer's account immediately without prejudice to other rights available to Magica Net under these Terms and Conditions.

  1. Customer's responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise, provided through the service or in the Internet generally.

Privacy Policy, Cancellation & Refund Policy

PRIVACY POLICY

This Privacy Policy (the "Policy") sets out how Magica Net, (hereinafter referred to as "Magica Net"), handles or deals with your Personal Information including Sensitive Personal Data which Magica Net collects, receives, possesses, stores, deals or handles while you use Magica Net's website, applications (hereinafter called as "apps") and services (collectively, "Magica Net Services/Products") or otherwise interact with us during the course of our relationship.

Registration, usage or purchase of any of Magica Net's Services / Products implies your express consent and agreement to this Policy.

This Policy may be modified in view of changes in business, technology, regulatory framework and the like. The modification will be intimated to you online. You are encouraged to regularly visit this page to review the policy and any modifications.

Collection of Information

To facilitate your seamless access to Magica Net Services / Products, billing, innovation, improvement, marketing and promotion and / or for complying with regulatory obligations, Magica Net may collect the following types of information:

  1. "Personal Information" i.e., information which either directly or indirectly, in combination with other information available or likely to be available with Magica Net is capable of identifying you, which without limitation may include the following:
    • Basic details which you provide during the registration process such as your Name, father's Name, mother's Name, spouse's Name, Date of Birth, Phone Number, Email Address, Communication or Permanent Address.
    • Photograph provided during registration or during the profile update.
    • Proof of Identity and Address such as Aadhaar Card, PAN Card, Driving License, Passport etc.
    • Transactions performed which can identify you as an individual through your customer ID or other relevant unique identifier.
    • Demographic details such as gender, city, and PIN code or nearest location.
    • Usage logs/Server logs/Cookies which may contain details of your Personal or Sensitive Personal Information.
    • Service specific information or identifiers such as International Mobile Subscriber Identity (IMSI), Mobile Station International Subscriber Directory Number (MSISDN), Customer ID etc.
    • Device specific information or identifiers such as International Mobile Equipment Identity (IMEI), OS specific identifiers.
    • Device specific information or identifiers such as Media Access Control Address (MAC Address), Internet Protocol Address (IP Address), Internet Protocol Detail Record (IPDR), Network Address Translation (NAT), Session Logs etc.
    • Note: For this policy, Sensitive Personal Data or Information is treated as a part of Personal Information, which may without limitation include the following:

    • Passwords or authentication information for any of Magica Net Services / Products.
    • Financial information, such as details of bank account, credit card, debit card, or other payment instrument details etc.
    • Biometric information.
  2. We are required under law to collect the following information, which is mandatory for provision of services to you:
    • Basic details which you provide during the registration process such as Name, Phone Number, Communication or Permanent Address.
    • Photograph provided during registration.
    • Proof of Identity Documents such as Aadhaar Card, Pan Card, Driving License, Passport.
    • Proof of Address Documents such as Driving License, Passport, Utility Bills.

    In the CAF, we have clearly identified fields which are mandatory and those which are optional. In case you refuse to provide your information or deny consent for the usage of the information provided or later withdraw your consent, we may choose to discontinue or deny the services for which the information was collected.

  3. Non-Personal Information which shall mean information that does not identify you or any other individual, and includes session, web sessions, internet usage, web beacons and usage and transaction data, aggregate log data and aggregate information. We may automatically collect information related to your use of Magica Net Sites - for example, we collect your computer's or mobile device's operating system type and version, Internet Protocol (IP) address, Computer or mobile or any other device ID, Wi-Fi network name (SSID - service set identifier) and strength, access times, browser type and language, and the websites you visited, search results, content and advertisements you select and view and content settings and preferences, channels you add and view, including time and duration in the channels, and other usage statistics. When you download or use apps created by Magica Net or our Affiliates, we may receive information about your location and your mobile device, including a unique identifier for your device. We use this information to inter-alia deliver our web pages to you upon request, to tailor our services to the interests of our users, to measure traffic within our services, to improve the quality, to better understand your needs, to remember your preferences, and to provide location-based services, targeted advertising, functionality and interactivity and let advertisers know the geographic locations from where our users/ visitors come. At any time while you are surfing Magica Net's website, if you do not wish to share surfing information, you may opt out of receiving the cookies from our website by changing privacy setting in your browser.

Use of Information

  1. The information provided by you to us is used for a number of purposes connected with our business operations which may include the following:
    • Verify your identity, access, privileges assigned and relationship with us.
    • Provisioning of products/services, testing or improvement of services, recommending various products or services;
    • to understand how you and other users are using the Magica Net Services and our other products and services in order to make them better;
    • Processing your requests, enquiries and complaints, customer services and related activities;
    • Communicating about Magica Net's Products including bills, invoices, confirmations, notices, updates, security alerts, support and administrative messages, existing or new offers, content, advertisements and promotional messages, user surveys, key policies or other administrative information;
    • to respond to your complaints, service requests, comments and questions and provide customer service;
    • to provide periodic maintenance and support to the Magica Net Services, including automatic software updates;
    • Analytics and reviews for improvement of our services;
    • to personalize your experience, suggest and offer you relevant content and display marketing and advertising tailored to your preferences on the Magica Net Website, App and other Magica Net Services, Third Party Channels, and other third-party websites, apps, platforms and devices;
    • Improving your experience while using our services by presenting advertising, products and offers tailored to you;
    • for marketing purposes, including sending you emails and text messages about products, events, promotions and offers from Magica Net or its partners or advertisers;
    • Completing your purchase / transaction;
    • to enforce our terms and conditions or protect our business, partners or users;
    • to protect, investigate, and deter against fraudulent, unauthorized, infringing or illegal activity;
    • Compliance with law and directions of law enforcement agencies or in connection with an investigation on matters related to public safety, as permitted by law or anti-fraud activities/systems; and
    • Other usages that you may consent to.
  2. We will make best efforts to keep your personal information confidential and will place reasonable security controls to protect it. Your Personal Information will be kept confidential as required under applicable laws.
  3. Magica Net may at its discretion engage Third Parties i.e., a Service Provider who associates with Magica Net and is involved in handling, managing, storing, processing, protecting and transmitting information of Magica Net and shall include all Sub-Contractors, Consultants and / or the representatives of such third party. Such third party though external to Magica Net shall be subject to contractual commitment to adhere to Magica Net's guidelines as to management, treatment and secrecy of Personal Information.
  4. Any comments, messages, blogs, scribbles etc. posted / uploaded / conveyed / communicated by you on the public sections of the apps/ website becomes published content and is not considered personal information subject to this Policy. You may request that such information be taken down and, we may attempt to remove any such information if it is technically feasible to do so and as per the applicable laws.
  5. We shall use Non-Personal Information automatically collected and stored by us to understand and analyse trends, to administer our services, to learn about user behaviour on the apps and while using our services, to gather demographic information about the user base as a whole and to measure traffic patterns on our network and apps. As Non-Personal Information does not personally identify you, we may use and disclose Non-Personal Information at our discretion.

Transfer of Information

Magica Net may transfer your Personal Information or other information collected, stored, processed by it to any other entity located in India or outside only in case it is necessary for providing services to you or if you have consented (at the time of collection of the relevant information) to the same. In the event of such transfer same level of data protection as is adhered to by us, will be ensured.


Sharing and Disclosure

  1. We do not sell or rent personal information to any third-party entities. We limit the disclosure of the Personal Information to certain circumstances, as provided below:
    • Mergers or acquisitions: In a scenario where we or our assets are merged or acquired by the other business entity, or during restructuring of business or re-organization, we may have to share information provided by you with the other business entities. Rest assured, if such a transaction occurs the other business entity or the newly combined business entity would be required to follow this Privacy Policy.
    • Partners: we engage a number of vendors, consultants, contractors and take support of our group companies or affiliates (hereon referred to as our Partners). Our Partners provide a host of services including contact information verification, payment processing, customer service, website hosting, data analysis, infrastructure provision, IT services, and other similar services. These Partners play a key role in seamless delivery of our products and services to you. These Partners and their employees operate under a contract and strict security & confidentiality restrictions. We may provide our partners access to your information through our systems or may share your Personal Information with them to enable them to provide their services to you.
    • Customer Initiated Sharing: Whenever you request us to share your information with a third-party website or application (for example, login to a third party using your Magica Net ID), we will provide a fresh notice and obtain consent from you regarding the details of the information that will be shared, before sharing the same. In such a case, Magica Net will not be in control of the information (shared with the third-party website/application or data generated based on your usage on that website/application) and Magica Net's privacy policy will not be applicable for any such use, access etc. Any processing, use, sharing of Information provided by you to such third-party website/application shall be as per the respective privacy policy of such applications and websites. You shall read and provide consent to the third party's privacy policy before requesting Magica Net to share the information.
    • Government or judicial process: We may share your Personal Information with the government / government authorities or agencies and legal or judicial authorities for any investigation or to comply with legal process or in response to a request by any of these authorities or to enforce applicable terms and conditions or to protect our, our users and Partners rights, privacy, safety or property.
    • Legal Reasons: The information provided by you may be shared with our other entities and affiliates to help in detecting and preventing identity theft, frauds and other illegal activities; correlate or map related accounts to prevent misuse of our products & services and to provide you, our services.
    • Protection of Magica Net: To protect your rights and/or those of our Partners, and to allow Magica Net to pursue available remedies or limit the damages that it may sustain in case of unauthorised use / misuse of our products or the content thereon, by third parties.

Storage, Retention and Security

  1. We have adopted reasonable security practices and procedures, in compliance with applicable policy, to include strategic, operational, managerial, technical, and physical security controls to safeguard and protect your data and information. We have implemented such measures, as stated above, to protect against unauthorized access to and unlawful interception of Personal Information. Additionally, we have adopted measures to ensure that your personal information is accessible to our employees or partners employees strictly on the need-to-know basis.
  2. Our website, applications, portals, and network equipment have industry standard security precautions in place to protect the loss, misuse and alteration of information which is in our environment. Whenever you change or access your account information, we facilitate the use of secure systems. The information in our custody and control is protected by adherence to reasonable security procedures in order to safeguard against unauthorized access. We apply encryption or other appropriate security controls to protect Personal Information when stored or transmitted by us.
  3. Your information or data will primarily be stored in electronic form. However, certain data can also be stored in physical form.
  4. We may enter into agreement with third parties to collect, store, process your information or data but under full compliance with applicable laws. These third parties may have their own security standards to safeguard your information or data and we will require such third parties to adopt reasonable security standards to safeguard your information / data on commercially reasonable basis.
  5. We have taken appropriate steps for the security and protection of all our digital platforms including internal applications, however, we shall not be responsible for any breach of security or the disclosure of Personal Information for reasons outside our control, such as hacking, social engineering, cyber terrorism, espionage by third parties, or any events by way of force majeure such as sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government.

Third Party Websites, Applications and Services

Magica Net Application/website may include links to other websites/applications. Such websites/application are governed by their respective privacy policies, which are beyond our control. Once you leave our servers, use of any information you provide may be governed by the privacy policy of the operator of the website/application you are visiting.

Whenever you request us to share your information with a third-party website or application (for example, login to a third party using your Magica Net ID), we will provide a fresh notice and obtain consent from you regarding the details of the information that will be shared, before sharing the same. In such a case, Magica Net will not be in control of the information (shared with the third-party website/application or data generated based on your usage on that website/application) and Magica Net's privacy policy will not be applicable. The third-party website/application will handle the information according to their own privacy policy. The customer shall read and provide consent to the third party's privacy policy before requesting Magica Net to share the information.


Access, Correction and Deletion

We shall make all efforts to keep our records updated and accurate with your latest information. You shall be responsible to ensure that the information or data you provide from time to time is and shall be correct, current and updated and you have all the rights, permissions and consent to provide such information or data.

Based on technical feasibility, we will provide you with the access to all your personal and sensitive personal information that we maintain about you. We will perform verification before providing you access to this information.

You may note that deletion of certain information or withdrawal of consent may lead to cancellation of your registration with us or your access to our services.
